and two hundred and eighty eight pounds of tobacco which to the same Richard
Tootell in the same Court before the Justices thereof at deviding Creek af.d were
adjudged for his damages which he had by occasion of a Certain promise and
assumption to the same Richard by the af.d John made and not performed
whereof he is Convict &a and the same day is given to the af.d Richard there
&a   Att which day here Came the said Richard Tootell by Robert Jenckins
Henry his attorney and the sherriffe of Somerset County to witt John Henry
Gent at the same day here returned that he had taken the af.d John Evans
whose body hereat this day he had ready to satisfie the af.d Richard Tootell
of the damages af.d as af.d he was Commanded &.a

Command was given to the Sheriffe of Somerset County that he should
take Wonney Macclemmey if he Should be found in his Bailywick and
    him should safe keep so that he might have his body before the Justices of his Lordships County
Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of June
Anno Dom One thousand Seven hundred and thirty Eight to Satisfie John Evans Late
of Somerset County planter of Six hundred and Eighty Seven pounds of tobacco which to the
same John in the Same Court before his said Lordships Justices at dividing Creek by discretion
of the Same Justices were adjudged for his Costs and Charges which he Sustained in a Certain
plea of trespass upon the Case &a by the said Wonney against the Same John in the Same
Court Impetrated according to the form of the Statute made and provided against parties
plfts which their writts in Such Manner of pleas do not prosecute or in the Same should
be precluded whereof he is Convict &.a  and the Same day is given to the afd John there &a
