301 Ann Dom one thousand seven hundred and thirty seven Confess Judgm.t to the said James Hayes with twenty Two pounds of tobacco additionall Costs according to act of assembly in Such Case made and provided whereof he is Convict &.a and the same day is given to the afd James Hayes there &a Att which day here Came as well the afd James Hayes in his proper person as the afd Littleton Townsend in his proper person and the same Littleton being by the Sheriffe Ledd to the Barr by vertue of the writt afd to him thereof directed and being by the Court here asked if was the very same Littleton Townsend the same person which the afd James Hayes in the Judgment afd was Convicted or not saith that he is Therefore the same Littleton Townsend is Committed to the prison of the Sheriffe of the County afd thereto remaine in Safe Custody untill the same James Hayes of the Judgm.t afd should be fully Satisfied & paid &a
bodys before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of June Ann Dom One thousand seven hundred and thirty Eight to Satisfie John Lay of Nine pounds three shillings Curr.t money of Maryland and Eight hundred and two pounds of tobacco which to the same John Lay in the same Court before the Justices thereof at dividing Creek afd were adjudged for his damages which he had by occasion of a Certain promise and assumption to the Same John Lay by the same Thomas and Nehemiah made and not performed whereof they are Convict &.a and the same day is given to the afd John Lay there &a Att which day here Came the afd John Lay by Francis Allen his attorney and the Sheriffe of Somerset County to witt John Henry Gent now here returned that he had taken the afd Thomas Collins and Nehemiah Holland whose bodys here at this day he had ready to satisfie the afd John Lay of the Judgm.t afd as afd he was Commanded &a
