29 same William Gray present herein Court in his proper person assumed upon himself) that if it should should happen that Judgment in the plea af.d in the same Court should be rendred for the same Isaiah Bredell against him the said William Gray or that he the said William Gray should be therein Convicted that then he the said William Gray should pay and Satisfie unto the af.d Isaiah Bredell the Judgment of the Court thereupon or Render his body in Execution of such Judgment to the prison of the sheriff of the County af.d thereto remain untill the same Judgment be satisfied unto the same Isaiah Bredell or that he the said George Dashiell will do the same for him And the aforesaid William Gray by George Douglas his attorney Cometh and Saving to himself all and all manner of advantages & Exceptions as well to the writt as the Narration afd prayeth Liberty to thereof to Imparle hereuntill the third Tuesday of November then next following and he hath it and the same day is given to the afd Isaiah here also &c Att which day here Came againe as well the afd Isaiah Bredell as the afd William Gray by their attorneys afd and whereupon the same William saving to himself all and all manner of advantages and Exceptions as well to the writt as the Narration afd prayeth further Leave thereof to Imparle here untill the third Tuesday of March then next following and he hath it and the Same day is given to the afd Isaiah here also &c Att which day here Came againe as well the afd Isaiah Bredell as the afd W.m Gray by their attorneys afd And whereupon the Same William defends the force and Injury when &c and says that he did not assume upon himselfe in manner and form as the said Isaiah above against him hath Complained and of that he putts himselfe upon the Country And afterwards the same day Last mentioned the said William relinquisheth his verification afd by him about pretended saith that that he Cannot deny the action afd of the afd Isaiah nor but that he did assume upon himselfe in manner and form as the afd Isaiah above against him hath Complained and as to the damage of the same Isaiah by him by occasion of the premisses in that part Sustained the Same William Saith and acknowledgeth that the afd Isaiah hath sustained damages by Occasion of the premisses beyond his Costs and Charges by him about his suit in that part apposed to four pounds One Shilling and Seven pence Curr.t money of Maryland and not more and because the afd Isaiah denys not this but the same allegation believes to be true prays Judgment for those damages above acknowledged together with his Costs and Charges afd to him to be adjudged &c Therefore by Consent of the parties afd it is Considered that the afd Isaiah Bredell recover against the afd William Gray his damages afd to the afd four pounds One Shilling and Seven pence Curr.t money of 329 Maryland in form afd acknowledged as also pounds of tobacco for his Costs and Charges afd to the same Isaiah at his request by the Court here of the assent of the parties afd adjudged which Certain damages in the whole do amount to four pounds one shilling & seven pence and pounds of tobacco with stay of Ex.n untill the first day of June then next following & the afd Wm in Mercy &c |
