keep so that they might have his body before the Justices of his Lordships County Court of Somerset to be held in the Court house at Dividing Creek in the same County the third Tuesday of November Anno Dom One thousand seven hundred and thirty Six to answer unto Richard Gildart Esq.r of a plea that he render unto him the Sum of Four thousand two hundred thirty & three pounds of good sound merchantable leafe tobacco and Cask which unto him he Oweth and unjustly detaineth &c and that thereof they should not fail &c Att which day here before the Justices of his Lordships County Court of Somerset held at dividing Creek in and for the same County Came the afd Richard Gildart by Will.m Goldsborough his attorney and the Coroners of the Same County here returned that they had taken the afd Joseph Macclester whose body here at this day they have here ready to answer the afd Richard Gildart of the afd plea as to them it was Commanded Whereupon a Certain William Beckingham and George Douglas of Somerset County Gent Came here before his Lordships Justices at dividing Creek afd in their proper persons and undertook and Each of them undertook ^to the same Joseph McClester^ and assumed upon themselves (Likwise the same Joseph Macclester present herein Court in his proper person assumed upon himselfe) that if it should happen that Judgment in the plea afd in the same Court should be rendered for the same Richard Gildart against him the afd Joseph Macclester or that the said Joseph MccClester should be therein Convicted that then he the said Joseph McClester should pay and Satisfie unto the said Richard Gildart the Judgment of the Court thereupon or render his body in Execution of Such Judgment to the prison of the Sheriff of the County afd there to remain untill the Same Judgment be fully Satisfied unto the same Richard or that they the same William Beckingham and George Douglas will do the same for him And Whereupon the same Joseph McClester puts in his place William Beckingham agaist against the afd Richard Gildart of the plea afd and upon this day is Given to the parties here before the Justices of his Lordships County Court of Somerset untill the third tuesday of March then next folowing in the state wherein they now are saving ^to the parties afd^ Att which day here Came againe as well the afd Richard Gildart as the afd Joseph McClester by their attorneys afd and hereupon the same Richard Gildart declared against the said Joseph ^McClester^ in the plea afd in form following |
