of tobacco to the said Russell when he should after that time he thereof Required
would faithfully pay and Content  Nevertheless the said John Harristoy
in his life time his promise and assumption af.d in form af.d made nothing
regarding but minding ^and fraudulently^ intending the said Russell in this part Craftily
and Subtilly to deceive and defraud the said quantity of tobacco or any
part thereof to the said Russell did not pay and the same tobacco or any
part thereof the said Israel and Esther or either of them since the death of the
said Harristoy to the said Russell have not paid but the same to pay altogether
have refused and still doth refuse altho' that to doe the said Harristoy
in his life time afterwards to witt the day and year af.d at the County af.d
and often afterwards and the said Israel and Esther afterwards to witt on
the third day of Mary Anno Dom MDCCXXXvij at the County af.d and
often since that time by the said John Russell were severally required  Whereupon
the said John Russell says he is damnifyed four thousand pounds
of tobacco and thereof he brings suit &.a    Pledges &a  J Doe & R Roe

Nov.r 20.th 1736   Then appeared before me the above John Russell
and gave me statisfactory testimony that the above account is Just
and true and also personally made oath that he never Rec.d of the
John in his lifetime any part or parcell thereof or any security or
Satisfaction thereof or of his Adm.rx since his death Jurat Coram

    Whereupon the said John Russell by his attorney afd prays that for as much as he [illegible]
in order to an attachment he may have Judgment against the afd Israel Holland and Esther his wife
adminrx of the afd John Harristoy for his damages afd by way of attachment according to act of
