of trespass upon the Case &.a   and the same day is given to the afd John there &a

             And the afd John Certified the Cause of the action afd in form following vizt  The Cause
of action in this Case is for that the said John Harristoy in his Life time received two thousand
four hundred pounds of tobacco in Lieu of ten pounds Curr.t money in gold or
Silver of a Certain Thomas Lord for the Use of John Russell afd and noe payment hath
been made thereof to the said Russell by the said Harristoy in his Life time or by the said
Israel and Esther or either of them since the death of the said John Harristoy

    A Copy of the foregoing Instrument of Writing was made and Sent to be Left at the
Last place of abode of the defend.t according to act of assembly in Such Case provided

Att which day here before his Lordships Justices at a Court then held at dividing Creek
Came the afd John Russell by George Douglas his attorney and the Sheriffe of Somerset
County to witt John Henry Gent now here returned that the afd Israel Holland & Esther
his wife were not found in his bailywick &a      And hereupon the said John Russell
declared against the afd Israel Holland and Esther his wife in the plea afd in form following

                   Somerset ss
                                           Israel Holland Late of Somerset County Marriner and
Esther his wife admrx of all and Singular the goods and Chattells and Creditts which were
of John Haristoy Late of Somerset County Merchant dec.d were attached to answer unto
John Russell of a plea of trespass upon the Case &.a

       And whereupon the said John Russell by George Douglas his attorney Complains
that whereas the said John Harristoy in his Lifetime to witt on the first day of
May Anno Dom MDCCXXXiii at the County afd was Indebted to the said John
Russell two thousand four hundred pounds of Tobacco for the Like quantity of tobacco
by the said Harristoy in his life of a Certain Thomas Lord for the use
of the said John Russell before that time had and Received as by acc.t
thereof hereto annexed may appear and so being thereof Indebted
on Consideration thereof afterwards to witt the day and year af.d at the
County af.d upon himself did assume and to the said John Russell then
and there faithfully promise that he the said Harristoy the said quantity
