in his proper person Cometh and defendeth the force and Injury when &.a  and thereupon the said John Henry
then & there his writt afd against the afd Wrixham did not prosecute with effect but Voluntarily suffered his
suit to be discontinued &a
                                           Therefore it is Considered that the afd John Henry take nothing by
his writt afd but be thereof in mercy for his false Clamour and that the afd Wrixham goe thereof without day &a

   Peter Stewart
    Command was given to the Coroners of Somerset County that they should take Peter
Stewart Late of Somerset County Merchant Otherwise Called Peter Steward of Somerset
County in the province of Maryland Merchant if he should be found in their bailywick and him
should safe keep so that they might have his body before the Justices of his Lordships County
Court of Somerset to be held at Dividing Creek in the same County the third Tuesday of June Ann Dom One
thousand Seven hundred and thirty Eight to answer unto John Henry Gent high sheriffe of Somerset County of
a plea that he render unto him Eight thousand pounds of good sound merchantable Leafe tobacco and Cask which
to him he Oweth and Unjustly detaineth &.a  and the same day is given to the afd John there &a

    Att which day here before his Lordships Justices at a Court then held at dividing Creek Cam in & for
the County afd Came the afd John Henry by Robert Jenckins Henry his attorney and the Coroners of Somerset
County to witt William Lane and Henry Ballard Gent now here returned that they had ready taken the
afd Peter Stewart whose body here at this day they had ready to answer unto the afd John of the afd plea
as to them it was Commanded      Whereupon the afd Peter Stewart in his proper person Comes and
defends the force & Injury when &a   And thereupon the afd John then & there his writt afd against the
afd Peter did not prosecute with Effect but Voluntarily Suffered his suit to be discontinued &.a

bailywick and them should safe keep so that he might have their bodys before the Justices of his Lordships
County Court of Somerset to be held at dividing Creek in the same County the third Tuesday of
June Ann Dom One thousand seven hundred and thirty Eight to answer unto John Russell of a plea
