    June Court                        1738                 294

County Court of Somerset to be held at dividing Creek in the Same County the third
Tuesday of June Ann Dom One thousand Seven hundred and thirty Eight to answer
unto Foster Cunliffe Esq.r of a plea of trespass upon the Case &.a and the Same day is
given to the afd Foster there &.a   Att which day here before his Lordships Justices at a
Court then held at dividing Creek came the afd Foster Cunliffe by William Goldsborough
his attorney and the Sheriffe of Somerset County to witt John Henry Gent now here returned
that he had taken the afd Mathew Kemp whose body here at this day he had ready to answer
unto the afd Foster of the afd Plea as to him it was Commanded

    Whereupon the afd Mathew Kemp in his proper person Cometh and defendeth the
force and Injury when &.a   And thereupon the said Foster Cunliffe then and there his
writt afd against the afd Mathew Kemp did not prosecute with Effect but voluntarily
Suffered his Suit to be discontinued &.a   Therefore it is Considered that
the afd Foster Cunliffe take nothing by his writt afd but be in mercy for his false Clamour
and that the afd Mathew Kemp goe thereof without day &.a

Command was given to the Coroners of Somerset County
that they should take Wrixham Crapper late of Somerset County
planter otherwise Called Rixham Cropper of Somerset County in the
province of Maryland planter if he should be found in their bailywicks and him should
safe keep so that they might have his body before the Justices of his Lordships
County Court of Somerset to be held at diving Creek in the same County the third
Tuesday of June Ann Dom One thousand Seven hundred and thirty Eight to answer
unto John Henry Gent high Sheriffe of the County afd of a plea that he render unto him
Eight thousand pounds of good sound Merchantable liefe tobacco and Cask which to him he oweth
and unjustly detaineth &.a and the same day is given to the afd John there &a

       Att which day here before his Lordships Justices at a Court then held at dividing
Court Came the afd John Henry by Robert Jenckins Henry his attorney and the Coroners of
Somerset County to witt William Lane & Henry Ballard Gent now here returned that they had
taken the afd Wrixham whos body here at this day they had ready to answer the afd John of
the afd plea as to them it was Commanded                        Whereupon the afd Wrixham in
