at deviding Creek in the same County the third tuesday of June Anno Dom one thousand seven hundred and thirty eight to answer unto Foster Cunliffe Esq.r of a plea of trespass upon the Case &a and the same day is given to the af.d Foster there &.a Att which day here before His Lordships Justices at a Court then held at deviding Creek Came the af.d Foster Cunliffe by William Goldsborough his attorney and the sherriffe of Somerset County to witt John Henry Gent now here returned that he had taken the af.d Mathew Kemp whose body hereat this day he had ready to answer unto the af.d Foster of the af.d plea as to him it was Commanded Whereupon the af.d Mathew Kemp in his proper person Comes and defends the force and Injury when &.a and thereupon the said Foster Cunliffe then and there his writt af.d against the af.d Mathew Kemp did not prosecute with effectt but volentarily suffered his suit to be discontinued Therefore it is Considered that the af.d Foster Cunliffe Esq.r take nothing by his writt af.d but be thereof in Mercy for his false Clamour and that the af.d Mathew Kemp goe thereof without day &.a
should safe keep so that he might have his body before the Justices of his Lordships County |
