291 damages by occasion of the premisses to 167 pounds of tobacco to the Same Nathaniel by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of the Statute in such Case made and provided by the Court here adjudged &a
body before the Justices of his Lordships County Court of Somerset to be held at deviding Creek in the same County the third tuesday of March Anno Dom one thousand seven hundred and thirty seven to answer unto James Bremin of a plea of trespass upon the Case &a and the same day is given to the af.d James here &.a Att which day here before his Lordships Justices at a Court then held at deviding Creek Creek Came the af.d James Bremin by Robert Jenckins Henry his attorney af.d and the sherriffe of Somerset County to witt John Henry Gent now here returned that he had taken the af.d Thomas Watkins whose body hereat this day he had ready to answer af.d James Bremin of the af.d plea as to him it was Commanded And the afd Thomas in his proper person Comes and saith that the Court here further to take Cognizance of the plea afd ought not because he saith that he the said Thomas at the day of the Issuing of the Originall writt of the aforesaid James Bremin in the plea af.d and long before was ^and^ still is an Inhabitant and resident in Calvart County in this province and not in this County of Somerset and never did abscond or fly from Justice in the said County of Calvart and that no Capias ad respondendum at the suit of the af.d James before the Impetration and sueing out the Original writ this |
