June Court                              1738            291

this Cause was sued out by the af.d James Bremin against the af.d Thomas
in the County of Calvart and returned by the sherriffe or Coroner of the said County
that the said Thomas in the said County of Calvart was not found Contrary
to the act of assembly in such case lately made and provided and this the
said Thomas is Ready to verify wherefore he prays Judgment if the
Court here will take further Cognizance of the plea af.d

    And thereupon the same James Bremin prays thereof day to Imparle and to him it is given
&a  And whereupon day thereof is given to the parties afd before his Lordships Justices untill at Next
Court to be held at dividing Creek in & for the County afd the third Tuesday of June then next following
and then to reply &a
                                     Att which day here Came againe as well the afd James Bremin by his attry
afd as the afd Thomas Watkins In his proper person and whereupon the afd James Bremin
then & there his writt afd against the afd Thomas Watkins did not prosecute with effect but voluntarily
suffered his Suit to be discontinued      Therefore afterwards to witt that same day by
discretion of the Justices here were adjudged the Same Thomas Watkins
173                                        pounds of tobacco for his Costs and Charges by him about his defence
in that part sustained according to the form of the Statute in Such Case thereupon lately made and
provided and the afd James in Mercy and the afd Thomas have thereof Execution &a

Command was given to the Sheriffe of Somerset County that he should take Thomas
Watkins Late of Somerset County Merchant if he should be
found in his bailywick and him should safe keep so that he
might have his body before the Justices of his Lordships County Court of Somerset
to be held at deviding Creek in the same County the third tuesday of March
Anno Dom one thousand seven hundred and thirty seven to answer unto Tench
Francis of a plea of trespass upon the Case &.a   and the same day is given
to the said Tench there &.a
