County Court of Somerset to be held at deviding Creek in the same County the third tuesday of March Anno Dom one thousand seven hundred and thirty seven to answer unto Thomas Storow of a plea of trespass upon the Case &a And the same day is given to the af.d Thomas here &a Att which day here Came the af.d Thomas Storow by William Beckingham his attorney and the sherriffe of Somerset County to witt John Henry Gent at the same day here returned that he had taken the af.d Nathaniel Carrington whose body hereat this day he had Ready to answer the af.d Thomas Storow of the af.d plea as to him it Commanded And hereupon the said Nathaniel Carrington puts in his place George Douglas Gent his attorney against the aforesaid Thomas Storow of the afd Plea Whereupon at the request of the parties afd day is to them now here given to be at the next Court to be held at dividing Creek in & for the County afd the third Tuesday of June then next following in the same State as at present saving to the parties afd &a Att which day here Came againe as well the afd Thomas Storow as the afd Nathaniel Carrington by their attorneys aforesaid And whereupon at the prayer of the afd Nathaniel Carrington by his attorney afd the afd Thomas Storow ^is adjudged to^ give Security for Costs (in Case he be nonsuited or otherwise Legally Cast) ^in the plea afd^ according to act of assembly in Such Case made and provided and it is said by the Court hereunto the afd Thomas that he give Security for the pay of Costs unto the afd Nathaniel as afd mentioned at his perill But the afd ^Thomas^ afterwards altho' solemnly required Comes not nor gives security for Costs as afd Therefore he and his pledges of Prosecuting be in mercy and Lett the plft name pledges &a and that the afd Nathaniel go there about day also it is Considered that the afd Nathaniel Recover against the afd Thomas Storow his damages |
