28 Bredell here also &c Att which day here Came againe as well the afd Isaiah Bredell as the afd William Gray by their attorneys aforesaid And whereupon the same Isaiah as before defends the force & Injury when &c and prays an hearing of the writing obligatory ^afd and he hath ^it^ and prays also an hearing of the Condition of the said writing obligatory^ and it is read to him in these words The Condition of this obligation is such that if the above bounded William Gray his ^heirs^ Executors administrators or assigns shall well and and truly pay or Cause to be paid to the above named Isaiah Bredell his heirs Executors or administrators the sum of thirty six pounds of bill of Credit of the said province of af.d on demand without fraud or further day then this obligation to be void and of none effect or else to stand and remain in full force and vertue which being read and heard the said William says that the said Isaiah his Action af.d against him to have and maintain ought not because he says that he the said William on the twenty eighth day of June Anno Dom seventeen hundred thirty and four at Somerset County af.d did pay to the said Isaiah the said sum of thirty six pounds Curr.t money of Maryland in the Condition af.d mentioned According to the force form and effect of the said Condition and this he is ready to verify Wherefore he prays Judgment if the said Isaiah his accon af.d against him the said William to have and maintain ought &c Whereupon the afd William Relinquisheth his verification afd by him above pretended saith that he Cannot deny the action afd of the afd Isaiah nor but that the writing Obligatory afd is his deed nor but that he oweth the Same Isaiah the afd seventy pounds Lawfull Curr.t money of Maryland in manner and form as the afd Isaiah first above against him declared Therefore it is Considered that the afd Isaiah Bredell recover against the afd Will.m Gray his debt afd and his damages by occasion of the detention of that same debt to pounds of tobacco to the same Isaiah of his assent by the Court here adjudged and the afd William in Mercy &c with stay of Execution untill the first day June then next following
Court house at dividing Creek in the same County the third tuesday of August Anno Dom one thousand seven hundred and thirty six to answer unto Isaiah Bredel of a plea of trespass upon the Case &c and that thereof he should ^not^ fail &c And hereupon the said Isaiah Bredell declared against the said William Gray in the plea af.d in form following Somerset County ss.t William Gray late of Stepn^e^y parish in the County of Somerset planter was attached to answer unto |
