28 was summoned to answer unto Isaiah Bredell of a plea that he render unto him seventy pounds of lawfull currant money of Maryland which to him he owes and unjustly detains &c And Whereupon the said Isaiah by Francis Allen his attorney saith that whereas the said Wm the twenty eighth day of June Anno Dom seventeen hundred and thirty four at the County of Somerset af.d within the Jurisdiction of this Court by his certain writing obligatory which the said Isaiah with the seal of the said William Signed hereinto Court brings the date whereof is the same day and year af.d did Acknowledge himself to be bound unto the said Isaiah in the af.d seventy pounds money af.d to be paid unto the said Isaiah when he should be thereunto required yett the said William tho' often required the said seventy pounds to the said Isaiah hath not rendred but the same to him hitherto to render hath denyed and still doth deny and unjustly detain Whereupon the said Isaiah saith he is worse and hath damage to the value of twenty pounds Curr.t money of Maryland and thereupon he brings suit &c Pledges &c John Doe & R Roe Att which day here before the Justices of his Lordships County Court of Somerset held at dividing Creek in and for the Same County Came the afd Isaiah Bredell by his attorney afd and the Sheriff of the Same County here returned that he had taken the afd William Gray whose body here at this day he hath here ready to answer the afd Isaiah Bredell of the afd Plea as to him it was Commanded Whereupon a Certain George Dashiell of Somerset County Gent Came hereinto Court in his proper person and undertook for the same William Gray and assumed upon himself (Lickwise the same William Gray present herein Court in his proper person assumed upon himself) that if it should happen that Judgment in the plea af.d in the same Court should be Rendred for the same Isaiah Bredell against him the said William Gray or that he the said William Gray should be therein Convicted that then he the said W.m Gray should pay and satifie unto the af.d Isaiah Bredell the Judgment of the Court thereupon or Render his body in Execution of such Judgment to the prison of the sheriff of the County af.d thereto Remain untill the same Judgment be satisfied unto the same Isaiah Bredell or that he the said George Dashiell will do the same for him And the aforesaid William Gray by George Douglas his attorney Cometh and defendeth the force and Injury when &c and prayeth Leave thereof to Imparle here untill the third Tuesday of November then next following And he hath it and the same day is given to the afd Isaiah here also &c Att which day here Came againe as well the afd Isaiah Bredell as the afd William Gray by their attorneys afd and whereupon the same W.m Gray prayeth further Leave thereof to Imparle here untill the third Tuesday of March then next following and he hath it and the same day is given to the afd Isaiah Bredell |
