himselfe did assume and to the said John at Somerset County afd then and there faithfully promise
that he said William would sail in the said Sloop from Pocomoke river afd to Sassafras river
aforesaid and take Sufficient Care of all Such tobacco or other Merchantdize as should be put on
board the said Sloop by the said John or any other person by his permission or order in the
said Voyage and the afd John in fact says that afterwards to witt on the day and year afd at
Sommerset County afd there was put on board the said Sloop the quantity of Twenty and Seven
hogsheads of tobacco by a Certain Robert Bolton by the permission and order of the said
John Dennis to be Caried to the Said River of Sassafras and the said John further
in fact says that ^he^ the said William was so Negligent in taking Care of the said tobacco so as
af.d by the said Robert put on board that the said tobacco by means of the Negligence of
the said William and for want of his sufficient Care f the said tobacco while it was on
board the said Sloop was afterwards to wit on the twenty seventh day of October in the
year af.d at Kent viz at Somerset County af.d was lost and Entirely damnified by
means whereof the said John as owner of the said vessel became Chargeable to pay to
^the said^ Robert Bolton the Damages which he the said Robert Bolton the damages which he
the said Robert sustained by means of ^the^ Loss spoiling and damnifying of the said
Tobacco and in fact did pay to the said Robert the sum of fourty pounds sterling
and Nineteen hundred pounds of tobacco for the damage done to the said to the said
tobacco whereupon the said John Dennis says he is damnified fifty pounds sterling and
four thousand pounds of tobacco and thereof he brings suit &c

    And the afd William Melven by William Arbuckle his attorney his attorney Cometh
and defendeth the force and Injury when &a and prayeth thereof to Imparle hereuntill
the next Court to be held at dividing Creek in and for the County afd the third Tuesday
of August ^then^ next ^following^ and he hath it and the Same day is given to the afd Jno Dennis Jun.r here
also &a                   Att which day here Came againe as well the afd John Dennis Jun.r as
the afd William Melvin by their attorneys afd and whereupon the Same William prayeth further
Leave thereof to Imparle hereuntill ^the^ next Court to be held at dividing Creek in and for the
County afd the third Tuesday of November then next following and he hath it and the same
