285 Creek in the same County the third Tuesday of June anno Dom One thousand seven hundred and thirty seven to answer unto John Dennis Jun.r of a plea of trespass upon the Case &a and the same day is given to the afd John here &.a Att which day here Came the afd John Dennis Jun.r by George Douglas his attorney and the Sheriffe of Somerset County to witt John Henry Gent at the same day here returned that he had taken the afd William Melvin whose body here at this day he had ready to answer the afd John Dennis Jun.r of the afd plea as to him it was Commanded Whereupon at the prayer of the afd John Dennis Jun.r the afd William Melvin is adjudged here to give Special Bail to the action afd Thereupon a Certain Robert Melvin of Somerset County planter present here in Court in his proper person undertook for the same William Melvin and assumed upon himselfe (LIkewise the same William Melvin present herein Court in his proper person assumed upon himselfe) that if it Should happen that Judgment in the plea afd should be rendered for the same John against him the Same William or that the Same William Should be therein Convict that then he the said William should pay and Satisfie unto the same John the Judgment of the Court thereupon or render his body in Execution of Such Judgment to the prison of the sheriffe of the County afd thereto remain untill the Same Judgm.t should be fully satisfied or that he the Same Robert Melvin will do the same for him And hereupon the said John Dennis Jun.r declared against the afd William Melvin in the plea afd in form following Somerset ss.t William Melvin Late of Somerset County planter was attached to answer unto John Dennis Jun.r of a plea of trespass upon the Case &a And whereupon the said John Dennis Jun.r by George Douglas his attorney Complains that whereas the af.d Whereas the aforesaid William on the tenth day of October Anno MDCCXXXvij at the County af.d on Consideration that he the said John at the Especiall Request of the said William did then and there agree and promise to pay to the said William the sum of thirty shillings Current money of Maryland for Every month that he should sail in a sloop or sea Vessell of the said John Called ^the^ Pokomoke from Pokomoke River in the County af.d to Sassafras River in Somerset County af.d and take sufficient care of all such tobacco's or their Marchandise as should be put on board the said sloop by the said John or any other person by his permission or order he the said William on Consideration thereof upon himselfe |
