286 day is given to the aforesaid William here also &a Att which day here Came againe as well the afd John Dennis Jun.r ^as the afd Willm Melvin^ by their attorneys afd and whereupon the same ^William^ pray^eth^ further Leave thereof to Imparle hereuntill the next Court to be held at dividing Creek ^in & for the County afd^ the third Tuesday of March then next following and he hath it and the same day is given to the afd William here also &a Att which day here Came againe as well the afd John Dennis Jun.r as the aforesaid William Melvin by their attorneys aforesaid And whereupon the same William Melvin pray^eth^ further Leave thereof to Imparle hereuntill the Next Court to be held at dividing Creek ^in & for the County afd^ the third Tuesday of June then next following and he hath it and the Same day is given to the afd John Dennis Jun.r here also &a Att which day here Came againe as well the afd John Dennis Jun.r As the afd William Melvin by their attorneys afd and whereupon the same William as before defends the force & Injury when &a and saith that he is no manner of way Guilty of the premisses by the plantiffs declaration upon him Imposed and of this he putts himselfe upon the Country and the afd John in Like manner And the afd William according to the Statute and with the Leave of the Court further Saith that the afd John his action afd against him to have and maintain Ought not because he Saith that at the time of the Making of the Contract and agreement in the plft declaration mentioned he was an Infant under the age of Twenty ^and^ One Years and this he is ready to verifie wherefore he prays Judg.t if the afd John his action against him to have Ought &a And as to the second matter by the said William above in Barr pleaded the said John Protesting that he the said William at the time of the promise afd in the declaration afd mentioned was of the full age of Twenty One Years for plea he says that he by any thing by the said William in his plea afd prealledged from having and Maintaining his action afd against the said William Ought not to be precluded because he Saith that before and at the time of the promise afd by the said William in the declaration afd Supposed to be made he the said William to work on Board of Shipps Sloops and other Vessells for hire and reward thereby to gaine ^for^ himselfe Necessary |
