281 was attached to answer unto Catherine Steward admrx of all and Singular the goods Chattles and Credits which were of the Reverand William Steward dec.d at the time of his death who dyed Intestate as it is sayed of a plea of trespass upon the Case &.a And Whereupon the same Catherine by Charles Goldsborough her attorney complaineth that whereas the af.d Richard the first day of april Anno Dom seventeen hundred thirty and three at Somerset County af.d was Indebted unto the af.d William Steward in his life time in the said sum of seven pounds Currt money of Maryland for divers works and services by the same William for the af.d Richard at his Instance and request before that time there done and performed and so thereof being Indebted the af.d Richard in Consideration thereof afterwards to wit the day and year afd at the County af.d upon himself did assume and unto the af.d William in his life time then and there faithfully did promise that he the af.d Richard the af.d sum of seven pounds Currt money unto the same William when thereof afterwards he should be required well and faithfully would pay and Content and altho the af.d Richard afterwards did pay and satisfie unto the af.d William the sum of one pound thirteen shillings and nine pence part of the af.d seven pounds Nevertheless the af.d Richard his promise and assumption af.d as to five pounds six shillings and three pence the Remainder of the af.d seven pounds nothing regarding but minding and fraudulently Intending the af.d William in his life time and the af.d Catherine after the death of the same William to which said Catherine administration of all and Singular the goods and Chattles Rights and Credits which where of the ^afore^said William at the time of his death after the death of the |
