279 Gullett of a plea of trespass upon the Case &.a And Whereupon the said Abraham by Robert Jenckins Henry his attorney complains that whereas the af.d Wonney the twenty day of March Anno Dom one thousand seven hundred thirty and seven at Somerset County within the Jurisdiction of this Court was Indebted unto unto the said Abraham in the sum of seven pounds and fifteen shillings Currt money of Maryland as by account herewith into Court brought may appear and so thereof being Indebted the said Wonney in Consideration thereof afterwards (to witt) the same day and year af.d at the place af.d upon himself did assume and to the said Abraham then and there faithfully did promise when afterwards he should be thereunto requested he would well and faithfully pay and Content and altho' the Woney hath paid to the said Abraham four pounds two shillings and nine pence part of the sum af.d Nevertheless the said Wonney as to three pounds twelve shillings and three pence Residue of the said seven pounds and fifteen shillings his promise and assumption af.d in form af.d made little regarding butt plotting and fraudulently Intending the same Abraham in that part Carftily and Subtilly to deceive and defraud the af.d three pounds twelve shillings and three pence or nor any part thereof to the same Abraham hath paid or him for the same any way Contented altho the said Wonney afterwards to witt the same day and year af.d at the County af.d and within the Jurisdication af.d by him the said Abraham was thereunto requested but the said Wonney the same to do hitherto altogether hath refused and still doth refuse whereby the same Abraham sayeth he is the worse and hath damage to the value of eight pound Currt money af.d and thereupon he brings suit &a Pledges &a J Doe & R Roe |
