279 premisses beyond his Costs and Charges by him about his Suit in that part apposed to four pounds ten Shillings and not more and because the afd Abraham denys not this but the Same allegation believes to be true prays Judgmt for those damages above acknowledged together with his Costs and Charges afd to him to be adjudged &a Therefore by Consent of the parties ^afd^ It is Considered that the afd Abraham Outten recover against the afd Richard Hubbart his damages afd to the afd four pounds ten Shillings by the Same Richard in form aforesaid acknowledged as also four hundred and fifty pounds of tobacco for his Costs and Charges afd to the Same Abraham at his request by the Court now here of the assent of the parties afd adjudged and the afd deft in mercy &a Afterwards to witt the Twentieth day of June Ann Dom One thousand seven hundred & thirty Eight Came hereinto Court the afd Richard Hubbart in his proper person And whereupon the Same Richard is Committed to the prison of the Sheriffe afd thereto remain untill the afd Abraham Outten of the damages Costs and Charges afd be thereof fully Satisfied &a
his body before the Justices of his Lordships County Court of Somerset to be held at deviding Creek in the same County the third Tuesday of June Anno Dom one thousand seven hundred and thirty eight to answer unto Abraham Gullett of a plea of trespass upon the Case &.a And the same day is given to the af.d Abraham Gullett there &.a And hereupon the said Abraham Gullett declared against the afd Wonney Macclemmey in the plea af.d in form following Somerset County ss.t Wonney M.ccClemmey Late of Somerset County planter was attached to answer unto Abraham Gullett |
