in any sort to Content hath altogether refused and still doth refuse altho' the
said four pounds ten shillings in Country pay afterwards to witt on the twenty
sixth day of December Anno Dom MDCCXXXvi and often since that time
to the said Abraham to pay he the said Rich.d hath been required  Whereupon
the said Abraham says he is damnifyed thirteen pounds Currt money of Maryland
and thereof he brings suit &a                                 Pledges &a  J: Doe & R Roe

A Copy of the foregoing decleration was made and sent to be served on the
deft with the writt af.d according to act of assembly in such case provided
Att which day here before his Lordships Justices at a Court then
held at deviding Creek Came the af.d Abraham Outten by his attorney af.d
and the sherriffe of Somerset to witt John Henry Gent now here returned
that he had taken the af.d Richard Hubbart whose body here at this day
he had ready to answer the af.d Abraham of the af.d plea as to him it
was Commanded and further the same sherriffe returned that he had
served the same Richard Hubbart with a Copy of the decleration af.d
according to act of assembly in such case provided &.a

Whereupon the said Richard Hubbart being present herein Court in his proper person
at the prayer of the afd Abraham he is adjudged to give Speciall Bail to the action
afd   but for want thereof the said Richard Hubbart is Committed into the Custody of
the Sheriffe of Somerset County thereto remaine &.a   And afterwards in the Same Court
Came the said Richard Hubbart in his proper person in Custody as afd and defends the force
and Injury when &a and Saith that he Cannot deny the action afd of the afd Abraham
nor but that he did assume upon himselfe in manner and form as the afd Abraham
above against him hath Complained and as to the damage of the same Abraham by
him by occasion of the premisses in that part Sustained the Same Richard and
acknowledgeth that the afd Abraham hath Sustained damages by occasion of the
