And Whereupon the said John by Robert Jenckins Henry his
attorney saith that whereas the af.d James the fifteenth day of December
day in the year of our Lord ^God^ one thousand seven hundred thirty and five at
Somerset County af.d within the Jurisdiction of this Court by his certain
writing obligatory did grant himself to be held and firmly bound to
the said John in the af.d sum of seventy pounds Currt money of Maryland
to be paid to the same John when thereof he should be requested

Nevertheless the af.d James altho' thereunto often requested
the af.d seventy pounds to the same John he hath not rendred but
the same to him hetherto to render hath denyed ^and still doth deny^  Wherefore he saith
that he is the worse and hath damage to the value of twenty pounds
Currt money of the province af.d and therefore he brings suit &a
and brings hereinto Court the writing af.d which the debt af.d in form
af.d doth testify the date of which is the same day and year above
mentioned &.a                             Pledges &.a John Doe & R Roe

Att which day here before his Lordships Justices at a Court then held at dividing
Creek in the Same County Came the afd John Leatherbury by his attorney afd and offers himselfe
against the afd James of the afd plea and he then Cometh not and the afd Sher
here returned that the afd James was not found in his bailywick &a

       Whereupon the said John Leatherbury by his attorney afd prays an attachment
against the goods Chattells Rights or Creditts of the afd James Collett according to act of
assembly in Such Case made and provided &.a and forasmuch it appears to the Court
here that the said John has Complyed with the Law as alledged

          Therefore it is Considered that the afd John Leatherbury recover against
the afd James Collett his debt afd and his damages by Occasion of the detention of
the Same debt by the Court hereof his assent adjudged by way of attachment against
635   the goods Chattells and Creditts of the said James Collett according to act of assembly
in such Case made and provided &a
