      of Elias

    Command was given to the Sheriffe of Somerset County that he Should take
Charles Rackliffe son of Elias Late of Somerset County planter if he Should
be found in his bailywick and him should safe keep
        so that he might have his body before the Justices of His Lordships County
        Court of Somerset to be held at deviding Creek in the same County the third
        tuesday of June Anno Dom one thousand seven hundred and thirty eight
        to answer unto Duncan Murray of a plea of trespass upon the Case &.a
       And the same day is given unto the af.d Duncan Murray there also &.a

                   And hereupon the afd Duncan Murray declared against the afd Charles
Rackliffe in the plea aforesaid in form following

       Somerset ss  Charles Rackliffe son of Elias Late of Somerset County planter
       was attached to answer unto duncan Murray of a plea of trespass
       upon the Case &.a

       And Whereupon the said Ducan by Geo: Douglas his
       attorney Complains that whereas the said Charles after the first
       day of May Anno Dom MDCCV to witt on the eleventh day of
       Augst Anno Dom MDCCXXXVIj at Somerset County af.d
       did make his certain note in writing called a promissary note
       with his proper hand subscribed bearing date the day and year last af.d and
       that note to the same Duncan then and there did deliver by which note the
       said Charles did promise to pay to the said Duncan or his order the sum of
       five pounds nine^teen^ shillings and nine pence Currt money of Maryland
       on or before the first day of January then next ensuing the date of the
       said Note for value Received by means whereof and by force of the statute
       in that case lately made and provided the said Charles became chargeable
       to pay to the said Duncan the said five pounds nineteen shillings
       and nine pence according to the tenor of the said note and so being thereof
       chargeable afterwards to witt the day and year last af.d at the County
