265 Court in their proper persons acknowledged themselves Indebted unto his Lordship the Lord Propry of the province of Maryland in five pounds Sterling Each of their severall goods and Chattells Lands and tenements Severall to be made and Levied if it Happen that the said Hannah Goldsmith do not make her personall appearance before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of August then next following and do not then and there give Such Evidence as she shall now against the afd John in relation to ^the^ begetting of the bastard Child afd and do depart the same Court without Leave &a
the tenth day of March Ann Dom seventeen hundred thirty and six at the parish af.d in the County af.d within the Jurisdiction of this Court did Commit fornication with acetain person to the Jurors af.d unknown and did permit the same unknown person then and there to have Carnal Knowledge of her body and to beget then and there a bastard Child on the body of her the same Elizabeth to the high Displeasure of Almighty God to the Evil Example of all others in such Case offending Contrary to the peace of the said Lord proprietary that now is his good Rule and Government and against the form of the Act of Assembly in such Case lately made and provided &a Testis Whittington Johnson On the foregoing Bill of Indictment it was Endorsed Billa vera Alex.d Leckie Foreman Thereupon Command was given to the sheriff of Somerset County that he should taken the said Elizabeth Smith of Somerset County if &a to answer &a and afterwards to witt the Twenty first day of March Ann Dom One thousand seven hundred and thirty Seven before his Lordships Justices at dividing Creek Came the afd Eliz.a Smith in her proper person and had a hearing of the Indictment afd and saith that she is not thereof Guilty and for tryall thereof she puts herselfe upon the Country and Robert Jenckins Henry Gent who for his said Lordship in this part followeth Likewise Thereupon the said Eliza Smith is ordered to give security for her appearance from day to day and Every day of this term to answer the premisses afd above upon her Imposed Thereupon the said Elizabeth Smith with Capell King of Somerset County Gent ^her security^ both present herein Court in their proper persons acknowledged themselves themselves Indebted unto his Lordship the Lord Proprietary in Twenty pounds Sterling Each of their goods and Chattells Lands and tenements severally to be made and Levied to the Use of his Lordships his heirs and successors to be made and Levied If it Happen that the said Eliz.a Smith doe not make her personall appearance from day to day and Every day of this term before his Lordships Justices |
