planter present herein Court in his proper person undertook for the said Richard
Hubbart and assumed upon himself (Likewise the said Richard Hubbart present
herein Court in his proper person assumed upon himself) that if it should happen
that Judgment in the plea af.d should be rendred for the same Abraham Outten against
him the said Richard Hubbart or that he the said Richard Hubbart should be ^thereof^ Convict
that then he the said Richard should pay and satisfie unto the said Abraham the
Judgment of the Court thereupon or render his body in execution of just Judgment
to the prison of the sherriffe of the County af.d in satisfaction thereof or but that
he the said Robert Givans will do the same for him

And whereupon the said Richard Hubbart puts in his place Francis Allen Gent
against the af.d Abraham in the af.d plea   Whereupon at the prayer of the parties
af.d day is to them here given to be before his Lordships Justices at the next Court to
be held at deviding Creek ^the^ third tuesday of march then next following in the same state
as at present saving to the parties af.d &.a

Att which day here Came againe the parties af.d by their attorneys af.d and whereupon
the said Richard diliveres up his body to the sherriffe of the County af.d in discharge of
his bail af.d and afterwards accordingly to an act of assembly in such case made
and provided was returned here the Instrument of writing in form following
Abraham Outten plantiffe against Richard Hubbart def.t  You Joshua Caldwell
do undertake for the said Richard Hubbart defendant in twenty pounds
Currt money of maryland to be levied in your lands and tenemants goods and
Chattells to the Use of the said Abraham Outten the plantiffe upon Condition that if the said
Abraham Outten do Obtain Judgment in an action of trespass upon the Case depending in the
County Court of Somerset against the said Richard Hubbart the defend.t that then the said Richard HUbbart
the deft that then the said Richard Hubbart shall pay the Condemnation of the Court thereupon or
deliver himselfe to the Custody of the Sheriffe of Somerset County in Satisfaction thereof or you would do it
for him he acknowledges himselfe to be Content therewith this twenty fifth day of March in the Year of our
Lord God One thousand seven hundred and thirty Eight                                                Jn.o Scott
