March Court           1737                    255

Richard Hubart shall pay the Condemnation of the Court thereupon or deliver himselfe to the
Custody of the Sheriffe of Somerset County in Somerset County in Satisfaction thereof or you would
do the same for him he acknowledged himselfe to be Content therewith this twenty fifth day
of March in the Year of Our Lord God One thousand Seven hundred & thirty Eight
To the Worshipfull Justices of Somerset County Court                  John Scott

    And whereupon the afd Henry Reynolds who brings the writt afd against the afd Richard Hubart
in the plea afd doth not prosecute his same writt      Therefore he and his pledges of prosecuting
being in mercy and Lett the plft name pledges &.a and that the afd Richard Hubart goe thereof
without Day  Also it is Considered that the afd Richard Hubart recover against the afd Henry
Reynolds his damages by occasion of the premisses afd to
195                             pounds of tobacco to the same Richard by discretion of the Justices here
at his request for his Costs and Charges in that part Sustained according to the form of the Statute thereof
made and provided by the Court here adjudged &a

    Command was given to the sherriffe of Somerset County that
he should take Richard Hubbart late of Somerset County
Bricklayer if he should be found in his bailywick and him
should safe keep so that he might have his body before the Justices of his
Lordships County Court of Somerset to be held at deviding Creek in the same
County the third tuesday of November Anno Dom one thousand seven hundred
and thirty seven to answer unto Abraham Outten of a plea of trespass upon
the Case &a and the same day is given to the af.d Abraham here &.a

Att which day here Came the af.d Abraham Outten by Geo: Douglas his attorney
and the sherriffe of Somerset County to witt John Henry Gent at the same
day here returned that he had taken the af.d Richard Hubbart whose body
hereat this day he had ready to answer the af.d Abraham Outten of the af.d plea as
to him it was Commanded         Whereupon at the prayer of the af.d Abraham
Outten the af.d Richard Hubbart is adjudged to give speciall bail to the action
af.d    Thereupon a Certain Robert Givans late of Somerset County
