1737 256 in the plea aforesaid doth not ^further^ prosecute his same writt Therefore he and his pledges of prosecuting be in mercy and Lett the plantiff name pledges &.a and that the af.d Richard Hubbart goe thereof without day Also it is Considered that the af.d Richard Hubbart recover against the af.d Abraham Outten his damages by occasion of 195 the premisses to pounds of tobacco to the same Richard by discretion of the Justices here at his request for his Costs and Charges in that part sustained according to the form of the statute thereof made and provided by the Court here adjudged &.a
Lordships County Court of Somerset to be held at deviding Creek in the same County the third tuesday of November Anno Dom one thousand seven hundred and thirty seven to answer unto Jacob Lookerman of a plea of trespass upon the Case &a Att which day here Came the af.d Jacob Loockerman by Charles Goldsborough his attorney and the sherriffe of Somerset County to witt John Henry Gent at the same day here returned that he had taken the af.d Joseph Macclester whose body hereat this day he had ready to answer the af.d Jacob Lookerman of the af.d plea as to him it was Commanded And Whereupon the said Joseph Macclester puts in his place Robert Jenckins Henry Gent against the af.d Jacob Lookerman in the af.d pleas Whereupon at the prayer of the parties af.d day is to them here given to be before his Lordships Justices at the next Court to be held at deviding Creek ^the^ third tuesday of march then next following ^to be^ in the same state as at present saving to the parties af.d &a Att which day here Came againe the parties af.d by their attorneys af.d and hereupon the said Jacob Lookerman declared against the af.d Joseph Macclester in the plea af.d in form following Somerset ss.t Joseph Macclester Late of Somerset County |
