at dividing Creek the third Tuesday of November Ann Dom One thousand seven hundred and thirty Seven to answer unto Henry Reynolds of a plea of trespass upon the Case &.a and the same day is Given to the afd Henry here &.a Att Which day here Came the afd Henry Reynolds by Robert Jenckins Henry his attorney and the Sheriffe of Somerset County to witt John Henry Gent at the same day here returned that he had taken the afd Richard Hubart whose body here at this day he had ready to answer the afd Henry Reynolds of the afd plea as to him it was Commanded Whereupon at the prayer of the afd Henry Reynolds the afd Richard Hubart is adjudged to give Speciall Bail to the action afd Thereupon a Certain William Porter Late of Somerset County planter present herein Court in his proper person undertook for the said Richard Hubart and assumed upon himselfe (Likewise the said Richard Hubart present herein Court in his proper person assumed upon himselfe) that if it should happen that Judgm.t in the plea aforesaid should be rendered for the Same Henry Reynolds against him the said Richard Hubbart or that he the said Richard Hubart should be thereof Convict that then he the said Richard should pay and Satisfie unto the said Henry the Judgment of the Court thereupon or render his body in Execution of such Judgm.t to the prison of the Sheriffe of the County aforesaid in satisfaction thereof or that he the said William Porter will do the same for him And whereupon the said Richard Hubart puts in his place Francis Allen Gent against the afd Henry in the aforesaid plea Whereupon at the prayer of the parties afd day is to them here given to be before his Lordships Justices at the next Court to be held at dividing Creek ^the^ third Tuesday of march then next following in the same State as at present saving to the parties afd &a Att which day here Came againe the parties afd by their attorneys aforesaid and whereupon the said Richard delivers up his body to the Sheriffe of the County afd in discharge of his bail afd and afterwards according to act of assembly in Such Case made and provided was returned here the following Instrument of writing in form following Henry Reynolds plft agt Richard Hubart deft You Joshua Caldwell do undertake for the said Richard Hubart defendant in the sum of thirty pounds Curr.t Money of Maryland to be Levied on your Lands and tenements goods and Chattells to the Use of the said Henry Reynolds the plantiffe upon Condition that if the said Henry Reynolds do Obtain Judgm.t in an action of trepass upon the Case depending in the County Court of Somerset against the said Richard Hubart the deft that then the said Richard |
