254 Creek the third Tuesday of November Ann Dom one thousand seven hundred and thirty seven to answer unto Duncan Murray of a plea of trespass upon the Case &.a and the same day is given to the afd Duncan here &.a Att which day here Came the afd Duncan Murray by George Douglas his attorney and the Sheriffe of Somerset County to witt John Henry Gent at the same day here returned that he had Taken the afd Charles Rackliffe whose body here at this day he had ready to answer the afd Duncan Murray of the afd plea as to him it was Commanded Whereupon at the prayer of the afd Duncan Murray the afd Charles Rackliff is adjudged to give Special Bail to the action afd Thereupon a Certain John Burton late of Somerset County planter present herein Court in his proper person undertook for the said Charles Rackliffe and assumed upon himselfe (Likewise the said Charles Rackliffe present here in Court in his proper person assumed upon himselfe) that if it should happen that Judgment in the plea afd should be rendered for the Same Duncan Murray against him the said Charles Rackliffe or that he the said Charles should be thereof Convict that then he the said Charles should pay and satisfie unto the said Duncan the Judgment of the Court thereupon or render his body in Execution of such Judgment to the prison of the Sheriffe of the County afd in Satisfaction thereof or that he the said John Burton will do the same for him And whereupon the said Charles puts in his place Francis Allen Gent against the afd Duncan in the afd plea whereupon at the request of the parties afd day is to them here given to be before his Lordships Justices at the next Court to be held at dividing Creek the third tuesday of March then next following in the Same state as at present saving to the parties aforesaid &a Att which day here Came againe the parties afd by their attorneys aforesaid and the afd Duncan Murray who brings the writt afd against the afd Charles Rackliffe in the plea afd doth not further prosecute his same writt Therefore he and his pledges of prosecuting be in mercy and Lett the plft name pledges &a and that the afd Charles Rackliffe goe thereof without day Also it is Considered that the afd Charles Rackliffe recover against the afd Duncan Murray his damages by occasion of the premisses to 207 pounds of tobacco to the Same Charles by discretion of the Justices here at his request for his Costs and Charges in that part Sustained according to the form of a Statute thereof made and provided by the Court here adjudged |
