24 for the same Ann Draper against him the said Henry Windsor or that he the said Henry Windsor should be therein Convicted that then he the said Henry Windsor should pay and satisfie unto the afd Ann Draper the Judgment of the Court thereupon or render his body in Execution of Such Judgment to the prison of the Sheriffe of the County afd thereto remaine untill the same Judgment be satisfied unto the same Ann Draper or that he the said Robert Given will do the Same for him And the said Henry Windsor by Francis Allen his attorney Cometh and defendeth the force & Injury when &c and prayeth Leave thereof to Imparle here untill the third Tuesday of August then next following and he hath it and the Same day is Given to the afd Ann Draper here also &c Att which day here Came againe as well the afd Ann Draper as the afd Henry Windsor by their attorneys aforesaid and whereupon the same Henry prayeth further Leave thereof to Imparle hereuntill the third Tuesday of November then next following and he hath it & the Same day is Given to the afd Ann Draper here also &c Att which day here Came againe as well the afd Ann Draper as the afd Henry Windsor by their attorneys afd And whereupon the Same Henry Windsor as before defends the force and Injury when &c and saith that he did not assume upon ^himselfe^ to the said Alexander in his Life time in manner & form as the said Ann above against him hath Complained and of this he puts himselfe upon the Country and the said Ann in Like manner Therefore it is Commanded the Sheriffe of the County afd that he should Cause to come here the third Tuesday of March then next following twelve &c by whom &a and who neither &c because as well &c and the same day is given to the parties afd there &c Att which day here Came againe as well the afd Ann Draper as the afd Henry Windsor by their attorneys afd and the Jurors of that Jury thereof Impannelled being Called Likewise Came to witt Nicholas Fountain Joshua Sturges Charles Townsend Joseph Houston Robert Mitchell Richard Chambers William Mumford Moses Driskill John Williams John Shiles John Pedden James Jones who to Say the truth of the premisses afd being duely Elected Tryed and Sworn and after that the Same Jurors of their Verdict thereof to say by the Court were Charged and from the Barr of this Court of their Verdict of and upon the premisses to render did goe back ^and^ between themselves to Commence and thereof amongst themselves being fully agreed and afterwards to the same Barr for their verdict in that part to render returned upon which the afd Ann Draper altho Solemnly Called Cometh not nor further prosecuted her writt & declaration afd against the afd Henry Windsor Therefore it is Considered that the aforesaid Ann Draper Executrix of the same Alexander Draper and her pledges of Prosecuting to witt John Doe & richard Roe be in mercy and that the afd Henry Windsor goe thereof without day &c |
