          March Court                1736         24

paid altho the same to do the said Henry by the said Alexander in his life time on the same
second day of November in year af.d and often afterwards and by the said Ann since the
decease of the said Alexander (to witt) on the second day of March seventeen hundred thirty and
five and often since at Somerset County af.d he was thereunto requested but the same to the
said Alexander in his life time or to the said Ann since the decease of the said Alexander to
pay the said Henry hath refused and the same to the said Ann doth still refuse to pay or
Content wherefore the said Ann saith she is the worse and damage to the value of forty pounds
Curr.t money af.d and thereof he brings suit &c and the same Ann brings her into Court the
Letters testementary of the af.d Alexander by which it may appear to the Court here she
the said Ann to be Executrix of the testament of the said Alex.d and thereof to have administration &c

Draper and made oath on the holy evangelist
of almighty God that the above Acc.t is a
true Copy from her deceased Husbands
Book sworn before me      Thos Gilliss

Whereupon came here into Court Robert
Givans late of Somerset County planter in
his proper person and undertook for
the Same Henry Windsor and assumed
upon himselfe [Likewise the Same
Henry Windsor present here in Court in
his proper person assumed upon himselfe]
that if it should Happen that
       Judgment in the plea aforesaid
       in the same Court should be rendered
