creek in the same County the third Tuesday of June Ann Dom One thousand Seven hundred and thirty Six to answer unto Thomas Nevett of a plea of trespass upon the Case &c and that thereof he should not fail &c Att which day here Cometh the af.d Thomas Nevett by William Beckingham his attorney and the sheriff of the County af.d to witt Joseph MccClester Gen.t at the same day returned that he had taken the af.d Henry Wingate and him hath here Ready According to the Exigence of the writt af.d Whereupon a Certain John Willey Late of Somerset County planter Came here into Court in his proper person and undertook for the same Henry Wingate and assumed upon himself [Likewise the same Henry Wingate present herein Court in his proper person assumed upon himself] that if it should happen that Judgment in the plea af.d in the same Court should be rendred for the same Thomas Nevett against him the said Henry Wingate or that he the said Henry Wingate should be therein Convicted that then he the said Henry Wingate should pay and satisfie unto the af.d Thomas Nevett the Judgm.t of the Court thereupon or Render his body in Execution of such Judgment to the prison of the sheriff of the County af.d thereto Remain untill the same Judgment be satisfied unto the same Thomas Nevett or that he the said John Willey will do the same for him And whereupon the same Henry Wingate puts in his place Robert Jenckins Henry against the afd Thomas Nevett of the afd Plea upon which day is given to the parties afd here before his Lordships Justices untill the third Tuesday of August then next following in the state wherein they now are saving ^to the partied afd^ &c Att which day here Came before the afd Justices as well the afd afd Thomas Nevett as the afd Henry Wingate by their attorneys afd and hereupon the said Thomas Declared against the afd Henry in the plea afd in form following Somerset County ss Henry Wingate late of Somerset County planter was attached to answer unto Thomas Nevett of a plea of trespass upon the Case &c And whereupon the same Thomas by W.m Beckingham his attorney complains that whereas the af.d Henry after the first day of may which was in the year of our Lord seventeen hundred and five to witt on the second day of may in the year of our Lord seventeen hundred and thirty five at Somerset County made his certain note in writing called a promissary note with |
