the Person who Imported the same two Hogsheads and three Barrels of Rum presumed
to Land and did Land the Same from on board of Some Vessell within the district and County
afd and the Jurisdiction afd without delivering any Invoyce or making any Entry thereof
to the said Levin Gale as Navall Officer as aforesaid Contrary to the form of the act of
assembly in such Cases provided and therefore the said Levin Gale prays the advice of the
Court here in the premisses and that the said Two hogsheads & three Barrells of rum for the
Cause afd may remain forfeited One Moyety thereof to the said Lord propry and the
Other Moyety to the said Levin Gale according to the form and Effect of the act of assembly
afd                  Whereupon proclamation was made for the Lord Proprietary (as the manner
is) if any person would Inform the Court here which the afd Two hogsheads & three
barrells of rum for the Cause afd should not remain forfeited that he should Come forth &
be heard and none so to do appearing  It is agreed that John Henry Gent sheriffe of
Somerset County be Commanded by writt of the said Lord Proprietary that now is under
the seal of this Court that the said Two hogsheads and three Barrells of rumm by the oath
of Honest and Lawfull men of the said County justly and faithfully to Cause to be
appraised making an Indenture thereof between him and the said appraisers &a so that
one part of the said Indenture he have here Immediately before his said Lordships Justices
now herein Court Sitting at dividing Creek and afterwards in the Same Court the said
Sheriff returns here the writt afd together with a Certain Indenture to the Same Writt annext
of which Indenture the tenor is as followeth vizt  This Indenture made the third day
of aprill in the Year of Our Lord God One thousand Seven hundred thirty and Eight
Between John Henry Gent Sheriffe of Somerset County of the one part and Robert Graham
and William McClemmey of the County afd Gent of the other part Wittnesseth that
that wee Robert Graham and William McClemmey appraisers according to a writt to
the said Sheriffe of Somerset County directed and hereunto annexed have tasted measured
and upon Oath appraised the two hogsheads and three Barrells of rum in the said
Writt Mentioned at the Value of Thirty three pounds seven Shillings Currt money of
this province of Maryland   In Wittness whereof wee have hereunto sett our hands and
fixed our Seals the day and year first above Written      Upon which was further
