243 to them or either of them before or since the espousals between them Celebrated to render hitherto hath denyed and still doth deny and unjustly detain altho' thereto afterwards by the said Comfort when she was sole to witt on the second day of May Anno Dom MDCCXXXv and by the said Charles and Comfort since the espousals between them Celebrated to witt on the first day of September in the year of Lord MDCCXXXvi and often since that the said Richard was required Whereupon they say they are damnifyed one hundred and thirty three pounds Currt money of maryland and thereof they bring suit &.a Pledges &a John Doe and Richard Roe Whereupon a Certain John Brittingham and James Houston both of Somerset County planters present herein Court in their proper persons undertook and each of them undertook for the af.d Richard Brooks and assumed upon themselves and each of them assumed upon himself (Likewise the same Richard Brooks present here in Court in his proper person assumed upon himself) that if it should happen that Judgment in the plea af.d should be rendred for the same Charles Stockley and Comfort his wife against him the said Richard or that then the said Richard should be therein Convicted that then they he the said Richard should pay and satisfye unto the said Charles Stockley and Comfort his wife the Judgment of the Court thereupon or render his body in execution of such Judgment to the prison of the sherriffe of the County af.d in satisfaction thereof or that they the said John Brittingham and James Houston or either of them will do the same for him And the af.d Richard Brooks by Robert Jenckins Henry his attorney comes and defends the force and Injury when &a and prayeth Leave thereof to Imparle here untill the next Court to be held at dividing Creek in and for the County af.d the third tuesday of March then next following and he hath it and the same day is given to the af.d Charles and Comfort here also &.a Att which day here Came againe as well the af.d Charles Stockley and Comfort his wife by their attorney af.d as the af.d Richard Brooks by his attorney af.d and the said Richard Brooks as before defends the force and Injury when &.a and saith that he Cannot deny the action af.d of the af.d Charles Stockley and Comfort his wife nor but that the writing obligatory af.d is the deed of the same Richard nor but that he oweth the same Charles and Comfort the af.d one hundred pounds Currt money of Verg.a of the value of one hundred and thirty three pounds Currt money of Maryland in manner and form |
