242 William and Tabitha the same altho' often thereto required to the said Thomas and Edmund or either of them have not rendred but the same to doe altogether have refused and still doe refuse to the damage of the said Thomas and Edmund two thousand pounds of tobacco and thereof they bring suit &.a Pledges &.a John Doe and Richard Roe Whereupon a Certain Ephraim Waggaman and Benjamin Holland both of Somerset County planters present here in Court in their proper persons undertook and each of them undertook for the afd W.m Jackson and Tabitha his wife and assumed upon themselves and Each of them assumed upon himself that if it Should happen that Judgment in the plea afd should be rendered for the Same Edmund and Thomas ag.t them the said William and Tabitha or that them the said William and Tabitha should be therein Convicted that then they the said William ^&^ Tabitha should pay and Satisfye unto the said Edmund & Thomas the Judgment of the Court thereupon or render their bodys in Execution of Such Judgm.t to the prison of the Sheriff of the County afd in Satisfaction thereof or that they the Said Ephraim Wagaman and Benjamin Holland or Each of them or Either of them will do the Same for them Thereupon the said William Jackson and Tabitha his wife pay agt the afd Edmund Baily and Thomas Evans may give Security for Costs in Case non Suit may be Obtained against them in the plea afd which is by the Court here Granted Whereupon Rob.t Jenkins Henry of Somerset County Gent present herein Court in his proper person undertook for the said Edmund Baily and Thomas Evans that in Case they be nonsuited in the plea afd or otherwise Legally Cast that then ^they^ the Said Edmund and Thomas should pay the Condemnation of the Court And all Costs accrewing thereon to the said William and Tibatha or that he the said Robert Jenckins Henry will do the same for them &a And the aforesaid William Jackson and Tabitha his wife by Francis Allen their attorney Come and defend the force and Injury when &.a and pray Leave thereof to Imparle here untill the next Court to be held at dividing Creek in and for the County aforesaid the third Tuesday of March then next following and they have it and the same day is given to the afd Edmund and Thomas here also &a Att which day here Came againe as well the afd Edmund Bayly and Thomas Evans by their attorney aforesaid as the afd William Jackson and Tabitha his wife by their attorney afd and whereupon the said William and Tibitha as before defend the force and Injury when &a and Say that they Cannot deny the action afd of the afd Edmund and Thomas nor but that they Owe the afd Edmond and Thomas the afd Nine hundred sixty and six pounds of tobacco or Eighteen hundred and Sixteen pounds of tobacco and fifteen Shillings Curr.t money of Vergenia of the Value of thirty Shillings Curr.t money of Maryland |
