242 to witt John Henry Gent now here returned that he had taken the af.d William Jackson and Tabitha his wife whose bodys hereat this day he had ready to answer the af.d Edmund Bayly and Thomas Evans of the af.d plea as to him it was Commanded And hereupon the said Edmund Bayly and Thomas Evans declared against the af.d William Jackson and Tabitha his wife in the plea af.d in form following Somerset ss William Jackson and late of Somerset County planter and Tabitha his wife were summoned to answer unto Edmond Bayly and Thomas Evans of a plea that they render unto them nine hundred and sixty and six pounds of tobacco or eight hundred and sixteen pounds of tobacco and fifteen shillings Currt money of Verginia of the value of thirty shilling Currt money of maryland which to them they owe and unjustly detain &.a And Whereupon the said Thomas and Edmund by Geo: Douglas their attorney say that whereas the said Thomas and Edmund at a County Court of our Soverign Lord King George the second at accomack County Court at the Court house of the said County to witt at Somerset af.d within the Jurisdiction of this Court on the ninth day of August Anno Dom MDCCXXXvij before his majestys Justices of the peace of the said County recovered against the said William and Tabitha as well five hundred pounds of tobacco for debt as four hundred and sixty six pounds of tobacco or three hundred and sixteen pounds of tobacco and fifteen shillings Currt money of Verginia (of the value of thirty shilling Currt money of maryland which by the Consideration of the said Court to the said Thomas and Edmond were adjudged for their damages which they sustained as well by occasion of detaining that debt as for their Costs by them about their suit in that behalf apposed whereof the said William and Tabitha are Convicted as by the Record thereof before the said Justices at accomack to witt in Somerset af.d remaining may more fully ^appear^ which said Judgment in its full force remains unreversed and unsatisfyed nor have the said Edmond and Thomas follow'd execution on the said Judgment by which action hath accrued to the said Thomas and Edmund to require and have of the said William and Tabitha the said nine hundred sixty and six pounds of tobacco or eight hundred and sixteen pounds of tobacco and fifteen shillings Curr.t money of Verginia of the value of thirty shillings Currt money of maryland Nevertheless the said William |
