And hereupon the said William Jones declared against the af.d Thomas Fletcher
in the plea in form following  Somerset sst  Thomas Fletcher late of all
hallows parish in Somerset County Clerk otherwise Called Thomas Fletcher
was summoned to answer unto William Jones of a plea that he render unto
him eight pounds two shillings and six pence Currt money of maryland
which to him he owes and unjustly detains &.a

And Whereupon the said William by Robert Jenckins Henry his
attorney sayeth that whereas the af.d Thomas the ninth day of September
in the year of our Lord God one thousand seven hundred thirty and six at
Somerset County within the Jurisdiction of this Court by his certain
writing obligatory did oblidge himself to pay or Cause to be paid to the
said William Jones his heirs or assignes the full and just sum of or quantity
of eight pounds two shillings and six pence Curr.t lawfull money of the
province of maryland at or upon the last day of April next ensuing
the date thereof  Nevertheless the said Thomas altho' often required
the af.d sum of eight pounds two shillings and six pence unto the said
William upon the last of April af.d or at any time since he hath not in any
^sort^ paid but the same to him the said William to pay hetherto hath refused and
still doth refuse and unjustly detain to the damage of the said William
five pounds like money as af.d and thereof he brings suit &.a and brings
hereinto Court the writing af.d which the debt af.d in form af.d doth testify
the date of which is the day and year above mentioned &.a

And the af.d Thomas Fletcher by Francis Allen his attorney comes and
and defends the force and Injury when ^&a^ and prayeth Leave thereof to
Imparle hereuntill the next Court to be held at deviding Creek in and
for the County af.d the third tuesday of November ^then^ next following and he
hath it and the same day is given to the af.d William here also &a

Att which day here Came againe as well the af.d William Jones as the af.d
Thomas Fletcher by their attorneys af.d and Whereupon the said Thomas
