240 Thousand pounds of Tobacco aforesaid and altho' the same Abraham and Martha his wife have been often thereunto Requested the aforesaid Two thousand pounds to of Tobacco to the said Day who as well &.c have not paid or as yet rendred but the same to the said Lord proprietary and the same Day Scott who &c hetherto to render have altogether refused and denyed and still to Render do Refuse and deny whereupon the said Day saith that he is the worse and hath damage to the Value of Two thousand pounds of Tobacco and thereof he brings suit &c Pledges &a John Doe R Roe And the aforesaid Abraham Cordery ^and Martha his wife^ by George Douglas their attorney ^afd^ Comes & defends the force Injury ^when^ &a and prayeth Leave thereof to Imparle hereuntill the next Court to be held at dividing Creek in and for the County afd the third Tuesday of November then next following and they have it and the same day is Given to the aforesaid Day Scott who as well &a here also &a Att which day here Came againe as well the afd Day Scott who as well &a by his attorney aforesaid as the aforesaid Abraham Cordery and Martha his wife by their attorney afd And whereupon the aforesaid Abraham Cordery and Martha his wife pray further Leave thereof to Imparle hereuntill the next Court to be held at dividing Creek in & for the County afd the third Tuesday of March then next following and they have it and the same day is given to the afd Day Scott who as well &a here also &a Att which day here Came againe as well the afd Day Scott who as well &a as the afd Abraham Cordery and Martha his wife by their attorney afd and whereupon the same Abraham and Martha as before defend the force and Injury when &a and say that they owe nothing to the said Day Scott who as well &a of the debt in the declaration mentioned and of this they put themselves on the Country And the said Day Scott who as well &a in like manner Therefore Lett Come thereof the Jury here Immediately before his Lordships Justices Last above mentioned and who neither &a to recognize &a because as well &a and the Jurors of that Same Jury by John Henry Gent Sheriffe of the County afd to this Impannelled being Came to witt Edmond Hough Thomas Dixson Isaac Marshall William Venables Jun.r Robert Mitchell John Fleming John Roach James Strawbridge Solomon Long Natha.ll Waller |
