239 the said Day Scott who as well &a declared against the afored Abraham Cordery and Martha his wife of in the plea afd in form following Somerset County ss Abraham Cordery Late of Somerset County Inholder and Martha his wife were summoned to answer unto Day Scott who as well for the Right Honourable the Lord Proprietary as for him selfe prosecuteth of a plea that they render unto the said Lord proprietary and the aforesaid Day Scott who as well &c Two thousand pounds of Tobacco which to the said Lord proprietary and the aforesaid Day Scott who as well &c they owe and unjustly detain &c And whereupon the said Day who as well for the said Lord proprietary as for himselfe prosecuteth by Robert Jenckins Henry his attorney saith that Whereas in a Certain Act of Assembly of this province of Maryland at a Session of Assembly begun and held at the Cyty of Annapolis the twenty sixth day of aprill in the first year of of the Reign of our Sovereign Lord George by the grace of God of Great Brittain france and Ireland King Defender of the faith &c Anno Dom one thousand Seven Hundred and Fifteen made and provided (among other things) it was Enacted by Authority of the same assembly that no person what so ever should trade Barter Comerce or any ways Deal with any servant whether Hired or Indented or Slave belonging or appertaining to any inhabitants with in this province without Leave or licence first had and obtained from such Servants Master Mistress Dame or overseer for his ^so^ doing under the penalty of Two thousand pounds of Tobacco the one halfe there of to the Right Honourable the Lord Proprietary of this province his heirs and successors for the support of Government the other half to the Master Mistress or true oner of such Goods so purloyed bartered or Conveyed away when proved by sufficient Wittness or Confession of the party to be Recovered in any Court of Record of this province by action of debt Bill plaint or Information wherein no Essoyn protection or Wager of Law to be allowed as (in the said Act among other things is fully Contained) Nevertheless the said Abraham Cowdry and Martha his wife the Act of Assembly aforesaid little weighing nor the penalty in the same Contained in any sort regarding after ^the^ publishing the Act aforesaid (to witt) on the Twentyeth day of Febuary in the year of our Lord God one thousand seven hundred thirty and six at stepny parish in the said County of Somerset with in the Jurisdiction of this Court did Trade Barter Comerce and deal with a Certain Christopher Lewis then and there being a servant to the said Day Scott then and still an Inhabitant in the parish and County aforesaid without leave or licence first had and obtained from the said Day the then Master of the said Christopher as aforesaid or from any other person mentioned and required by the said at; to Justify their so doing did barter with and receive from the said Christopher Lewis (then and there being a servant to the same Day one shilling Current Money of Maryland in Contempt of the said Lord proprietary that now is and to the Grievous Damage of him the said Day and Contrary to the form of the Act of assembly aforesaid by which action hath accrued to the same Day who as well for the said Lord proprietary as for himselfe in this part prosecutes to Require and have of the aforesaid Abraham Cordery and Martha his wife for the said Lord proprietary and himselfe the Two Thousand |
