23 who to say the truth of the premisses afd being Elected tryed and Sworn upon their Oath say that the said John Britt did assume upon himself in manner and form as the afd Thomas Fletcher above against him hath Complained and assessed the damages of the Same Thomas beyond his Costs and Charges by him about his Suit in that apposed to Twelve pounds Currant money of maryland and for those Costs and Charges to one pound of tobacco Therefore it is Considered that the afd Thomas Fletcher recover against the said John Britt his damages afd by the Jurors afd in form afd assessed also pounds of tobacco for his Costs and Charges aforesaid to the same Thomas by the Court here of his assent of Increase adjudged which Certain damages in the whole doe amount to Twelve pounds Currant money of Maryland and pounds of tobacco and the afd John Britt in mercy &c
the said Henry the second day of November in the year of our Lord one thousand seven hundred thirty and three at Somerset County within the Jurisdiction of this Court was Indebted unto the af.d Alexander in his lifetime the sum of nine^teen^ pounds six shillings and eight pence Curr.t money of Maryland for divers goods wares and Merchandize poperly chargeable in an Account (as by an Account thereof hereinto Court brought may appear) and so thereof being Indebted the said Henry afterwards (to witt) the same day and year af.d at the place af.d upon himself in Consideration thereof did assume and to the said Alexander in his life time then and there faithfully did promise that when afterwards he should be thereunto requested he would well and faithfully pay and Content and altho the said Henry one pounds seven shillings and four pence part of the af.d nineteen pounds six shillings and eight pence to the said Alexander in his lifetime he since paid and Satisfied Nevertheless as to seventeen pounds nineteen shillings and four pence of the af.d nineteen pounds six shillings and eight pence Residue the said Henry his promise and assumption af.d in form af.d made nothing regarding but plotting and fraudulently intending the said Alexander in his lifetime and the same Ann in that part after the death of the said Alexander Craftily and Subtilly to deceive and defraud the af.d seventeen pounds nineteen shillings and four pence or any penny thereof to the af.d Alexander in his life time or to the af.d Ann since the decease of the said Alexander he hath not paid |
