assumed upon himselfe that the said Benjamin Townsend should pay and satisfie unto the
afd Day Scott the Judgmt of the Court afd and all Costs Charges and Damages that should likewise
be adjudged unto the afd Day in Equity In case the Chancery Court should decree the same
or render his body in Execution of Such Judgmt Costs Charges and Damages in Satisfaction thereof or
that he the said Joseph Dashiell will do the same for him &a

     Command was given to the Sheriffe of Somerset County
that he Should take Abraham Cordery Late of Somerset County
Inholder and Martha his wife if they Should be found in his bailywick
and them should safe keep so that he might have their bodys before the
Justices of his Lordships County Court of Somerset to be held at dividing Creek in the
Same County the third Tuesday of March Ann Dom One thousand Seven hundred
and thirty Seven to answer unto Day Scott who as well for his said Lordship as for
himselfe prosecuteth of a plea that they render unto his said Lordship and the said
Day Scott who as well &a two thousand pounds of tobacco which to his said Lordship
and the afd Day Scott who as well they Owe and Unjustly detaine &a and the
Same Day is given to the said Day Scott who as well &a   Att which Day here Came before
his Lordships Justices at a Court then held at Dividing Creek in the same County Came the
aforesaid Day Scott by Robert Jenckins Henry his attorney and the afd sheriffe to witt
Joseph McClester Gent now here returned that he had taken the afd Abra: Cordery &
Martha his wife whose Bodys here at this day he had ready to answer the afd Day Scott
who as well &.a of the afd plea as to him it was Commanded        And Whereupon
the afd Abraham Cordery and Martha his wife puts in their place George Douglas Gent
against the afd Day Scott who as well &a in the plea afd   Whereupon at the request
of the parties afd day is to them here given to be before his Lordships Justices at the next
Court to be held at Dividing Creek In & for the Same County the third Tuesday of August
then Next following to be in the same State as at present saving to the parties &a

Att which day here Came againe as well the afd Day Scott who as well &a by his attorney afd
as the afd Abraham Cordery and Martha his wife by their attorneys afd and hereupon
