234 have his body before the Justices of his Lordships County Court of Somerset to be held at dividing Creek in the Same County the third Tuesday of June Ann Dom One thousand Seven hundred and thirty Seven to answer unto John Purnall Jn.r of a plea of trespass upon the Case &.a and the same day is Given to the afd John here &a Att which day here before his Lordships Justices at a Court then held at dividing Creek in the Same County Came the afd John Purnal Junr by George Douglas his attorney and the aforesaid Sheriffe to witt Joseph MccClester Gent now here returned that he had taken the afd Richard Holland whose body here at this day he had ready to answer the afd John Purnall of the afd Plea as to him it was Commanded And whereupon the same Richard Holland puts in his place Robert Jenckins Henry Gent his attorney against the afd John Purnall in the plea afd Whereupon at the request of the parties ^afd^ day is to them here given to be before his Lordships Justices at the next Court to be held at dividing Creek in & for the County aforesaid the third Tuesday of August then next following in the same State as at present saving to the parties &a Att which day here Came againe as well the afd John Purnall as the aforesaid Richard Holland by their attorneys afd And hereupon the said John Purnall declared against the afd Richard Holland in the plea afd in form following Somerset Co: ss: Richard Holland late of Somerset County planter was attached to answer unto John Purnall Jun.r of a plea of trespass upon the Case &a And Whereupon the Same John by George Douglas his attorney Complaines that whereas the said Richard Holland on the third day of May Anno Dom MDCCXXXvi at the County aforesaid was Indebted to the said John in the sum of six pounds Current money of Maryland for a horse by the said John to the said Richard at the Especial request and Instance of the said Richard before that time Sold and Delivered as by an account into Court brought more manifestly may appear and so being thereof indebted afterwards on Consideration thereof upon himselfe did assume and to the said John then and there faithfully did promise that he the said Richard the said six pounds to the said John when he should thereof be afterwards required well and faithfully he would pay and Content Nevertheless the said Richard his promise and assumption aforesaid in form aforesaid made nothing regarding but minding and fraudulently intending the said John in that part Craftily and Subtilly deceive and defraud the said six pounds to the said John hath not paid or him for the same in any sort Contented but the same to him to pay hitherto hath refused and still doth refuse altho thereto afterwards to wit the day and year aforesaid at the County aforesaid and often since that time by the said John required whereupon the said John says he is damnified twenty pounds Current money of Maryland and thereof he brings suit &c Pledges &a John Doe R Roe 1736 Dr Richard Holland to John Purnall Cr may 3 To one horse £6..0..0 By £00..02..6 p John Purnall March the 21.st day 1737 Then was the above accot proved by the Oath of John Purnall Jun.r according to act of assembly Test Thomas Hayward Cl Cur And |
