performed all and Singular the matters and things in the af.d Condition on
the part of the said John to be performed mentioned for plea she says that the said
Hugh his accon thereof against her to have and maintain ought not because
she says that the said John in his life or she the said Admx of the said John or
the Ex.rs or heirs of the said John since his death or either of them have not before
the Impetration of the originall writt in this Case and since the making of the
said writing obligatory been requested by the said Hugh to make over alienate
and Confirm unto the said Hugh Stevenson or to his Ex.rs or adm.rs as the Law
in such cases directs the said two tracts or parcell of Land in the Condition af.d
Specifyed with all the houses orchards Gardens and all appurtenances thereunto
belonging or to leath and plaster two rooms above stairs in the dwelling house
and finish the mantle peice and make doors for said Rooms and this she is
ready to verify whereupon she prays Judgment if the said Hugh his accon
thereof against her to have and maintain ought &.c

    Whereupon the same Catherine Donelson relinquisheth her verification afd by her above
pretended and saith that she Cannot deny the action afd of the afd Hugh Stevenson nor
but ^that^ the writing Obligatory afd is the deed of the Same John Donelson nor but that she
unjustly detaineth from the afd Hugh the afd Two hundred pounds Currt money of the
province afd in manner & form as the aforesaid Hugh above against her hath declared

Therefore it is Considered that the afd Hugh Stevenson Recover against the afd Catherine
Donelson his debt afd as also his damages by occasion of the detention of the same debt to
455                                                                           pounds of tobacco to the same Hugh
Stevenson of his assent by the Court here adjudged of the goods and Chattells which were of
the aforesaid John at the time of his death in the hands of the afd Catherine to be administed
if so much in her hands she hath and if so much in her hands she had not than the
damages afd to be Levied of the proper goods and Chattells of the same Catherine and the afd
Catherine in mercy &a  Memorand.m the plft releaseth all the above debt Save Nine
pounds Curr.t Money of Maryland & Costs of Suit &a
