232 William Porter as before defends the force and Injury when &.a and prays Judgmt of the declaration aforesaid because he saith that the Declaration aforesaid and the Matter in the same Contained are not sufficient in law for the aforesaid William Nelson his Action aforesaid against him the said William Porter to have and Maintain to which the said William hath not need nor by the Law of the Land is he held in any sort to answer and this he is ready to verify wherefore for want of a sufficient Declaration in that parte the said William Porter prays Judgment of that Declaration and that the said Declaration may be quashed &c afterwards the same day the aforesaid William Porter relinquisheth his verification afd by him above pretended and saith that he Cannot deny the action afd of the aforesaid William Nelson nor Can he say but that the Bond of writing obligatory aforesaid is his deed nor ^can he say^ but that he doth detaine from the afd William Nelson the aforesaid one hundred pounds Currant money of Maryland in manner and form as the afd William Nelson above against him declared Therefore it is Considered that the aforesaid William Nelson Executor of the afd Hugh Nelson dec.d Recover against the aforesaid William Porter his debt aforesaid and his damages by occasion of the detention of the same debt to five hundred and thirty five pounds of tobacco to the same Will.m Nelson of his assent by the Court here adjudged and the afd deft in Mercy Memorand.m the plft releaseth all the debt above saving fourteen pounds ten shillings Currt Money of Maryland &a
Called John Donnelson of Somerset County and province of Maryland Mercht if she should be found in his bailywick and her should safe keep so that he might have her body before the Justices of his Lordships County Court of Somerset to be held at deviding Creek in the same County the third tuesday of June Anno Dom one thousand seven hundred and thirty seven to answer unto the Rev.d Hugh Stevenson of a plea that she render unto him two hundred pounds Currt and lawfull money of the af.d province which from him she unjustly detains &.a and the same day is given to the af.d Hugh here &.a Att which day here before his Lordships Justices at a Court then held at deviding Creek in the same County Came the af.d Hugh Stevenson by Francis Allen his attorney and the af.d Sherriffe to wit Joseph Macclester Gent now here returned that he had taken the af.d Catherine Donnelson |
