232 which form him he unjustly detains &c And whereupon the said William Nelson by Geo: Douglas his Attorney says that whereas the said William Porter on the Eleventh day of October Ann Dom MDCCXXXiv at Somerset County aforesaid by his Certain writing obligatory which the said William Nelson sealed with the seal of the said William Porter here into Court brings whose date is the day and year aforesaid did acknowledge him self to be held and firmly bound unto the said Hugh Nelson in his life time in the aforesaid sum of one hundred pounds Current money af.d to be paid to the said Hugh Nelson his Certain Attorney heirs Executors Adm.rs or assignes and to the payment of the said sum did oblige himself his heirs Executors and Administrators by the said writing obligatory Nevertheless the said William Porter the said one hundred pounds to the said Hugh in his life time or to the said William Nelson Ex.rs of the said Hugh since his death hath not rendred but the same to them or either of them to render hitherto hath denied and the same to the said William Nelson to render still doth deny and unjustly detain altho the same to doe to the said Hugh in his life time to wit on the twenty sixth day of December Ann Dom MDCCXXXv at the County af.d and often since that time by the said Hugh required and altho' thereto afterwards viz on the first day of September Ann Dom MDCCXXXVi at the County af.d by the said William Nelson after the death of the said Hugh the said William Porter was required whereupon the said William Nelson says he is damnified one hundred pounds Curr.t money of Maryland And thereof he brings suit &c And the said William Nelson brings into Court here the testamentary letters in due form of Law to him granted which testify him to be Executor of the testament and last will of the said Hugh and thereof to have Administration &c Pledges &a John Doe R Roe And the aforesaid William Porter by Francis Allen his attorneys Cometh ^and defendeth the force & Injury when &.a^ and Saving to himselfe all advantages as well to the writt as to the declaration afd prayeth Leave thereof to Imparle here untill the next Court to be held at dividing Creek in the Same County the third Tuesday of November Ann Dom One thousand Seven hundred & thirty Seven and he hath it & the same day is given to the afd William Nelson here also &a Att which day here Came againe as well the afd William Nelson as the aforesaid William Porter by their attorneys aforesaid And whereupon the Same William Porter prays saving &a prays further Leave thereof to Imparle here untill the next Court to be held at dividing Creek the third Tuesday of March Ann Dom One thousand Seven hundred and thirty Seven and he hath it and the Same day is given to thee afd Willm Nelson here also &a Att which day here Came againe as well the afd Will.m Nelson as the afd William Porter by their attorneys afd And whereupon the same Will.m |
