233 Donnelson whose body hereat this day he ready to answer the af.d Hugh Stevenson of the af.d plea as to him it was Commanded And hereupon the said Hugh Stevenson declared against the af.d Catherine Donnelson in form following Somerset County sst Catherine Donnelson late of Somerset County widdow admrx of all and Singular the goods and Chattles Rights and Credits of John Donnelson Late of the said County Merchant otherwise lately Called John Donnelson of Somerset County and province of maryland merchant was summoned to answer unto the Revd Hugh Stevenson of a plea that she render unto him two hundred pounds Currt and lawfull money of the af.d province which from him she unjustly detains &a And Whereupon the said Hugh by Francis Allen his attorney saith that whereas the said John in his life time to witt the thirteenth day of February Anno Dom seventeen hundred and twenty eight nine at the County of Somerset af.d within the Jurisdiction of this Court by his certain writing obligatory which the said Hugh with the seal of the said John in his life time signed here into Court brings the date whereof is the same day and year af.d did acknowledge himself to be bound unto the said Hugh in the af.d two hundred pounds Currt money af.d to be paid unto the said Hugh when he should be thereunto required yett the said John in his life time nor the af.d Catherine since the decease of the said John to whom admrcon of all and singular the goods and Chattles &a of the af.d John after the decease of the said John was granted tho' often required the said two hundred pounds to the said John have not rendred but the same to him (the said John in his life time to render hath denyed and the said Catherine the same to the said Hugh since the decease of the said John to render still doth deny and unjustly detain to the damage of the said Hugh of Forty pounds Currt money of maryland and thereupon he brings suit &a Pledges &a J Doe & R Roe And the aforesaid Catherine Donelson by George Douglas her attorney Cometh and defendeth the force and Injury when &a and prayeth Leave thereof to Imparle here untill the next Court to be held at dividing Creek in and for the County aforesaid the third Tuesday of August then next following and she hath it and the same day is Given to the afd Hugh Stevenson here also &.a Att which day here Came againe as |
