Court of Somerset to be held at dividing Creek in the Same County the third tuesday of June Ann Dom One thousand seven hundred and thirty Seven to answer unto William Nelson Executor of the testament and Last Will of Hugh Nelson of a plea that he render unto him one hundred pounds Curr.t money of Maryland which from him he unjustly detaines &a and the same day is given to the aforesaid William Nelson here &a Att which day here before his Lordships Justices at a Court then held at dividing Creek in the same County Came the afd William Nelson by George Douglas his attorney and the afd sheriffe to witt Joseph Macclester Gent now here returned that he had taken the aforesaid William Porter whose body here at this day he had ready to answer the afd William Nelson of the afd plea as to him it was Commanded Whereupon at the same day Came here into Court Francis Porter of Somerset County planter and in his proper person and undertook for the afd William Porter and assumed upon himselfe (Likewise the Same William Porter present here in Court in his proper person assumed upon himselfe) that if it Should happen that Judgmt in the plea afd should be rendered for the Same William Nelson against him the Said William Porter or that the said William Porter Should be therein Convict that then he the said William Porter should pay and Satisfie unto ye said William Nelson the Judgment of the Court thereupon or render his Body in Execution of such Judgment to the prison of the Sheriffe of the County afd in Satisfaction thereof or that he the said Francis Porter will do the same for him And whereupon the said William Porter puts in his place Francis Allen Gent attorney at Law against the afd William Nelson in the plea afd Whereupon at the request of the parties afd day is given to them here ^to be^ before the Justices of his Lordships County Court of Somerset to be held at dividing Creek the third Tuesday of August Ann Dom One thousand Seven hundred and thirty Seven in the Same State as at present saving to the parties &a Att which day here Came againe the parties afd by their attorneys afd and hereupon the same William Nelson declared against the afd William Porter in form following Somerset ss William Porter Late of Somerset County Carpenter otherwise Called William Porter of Somerset County in the province of Maryland Carpenter was summond to answer unto William Nelson Executor of the testament and last will of Hugh Nelson of a plea that he render unto him one hundred pounds Current money of Maryland which |
