231 November Anno Dom one thousand seven hundred and thirty seven and he hath it and the same day is given to the af.d William here also &a Att which day here Came againe as well the af.d William Draper as the af.d Frances Bowger by their attorneys af.d and whereupon the said Frances Bowger prayeth further leave thereof to Imparle here untill the next Court to be held at deviding Creek in and for the County af.d the third tuesday of March Anno Dom one thousand seven hundred and thirty seven and she hath it and the same day is given to the af.d William here also &.a Att which day here Came againe as well the aforesaid William Draper as the afd Frances Bowger by their attorneys aforesaid And Whereupon the aforesaid Frances as before defends the force and Injury when &a and saith that she did not assume upon himselfe in manner and form as the said William above against her hath Complained and of this she puts herselfe upon the Country &a and the said William in Like manner And afterwards the same Frances by her attorney afd relinquisheth the verification afd by her above pretended and saith that she Cannot deny the action afd ^of the afd^ William Draper nor Can he Say but that the said Francis did assume upon herselfe in manner & form as the aforesaid William above against her hath Complained nor Can he say but that the said William ought to recover his damages against the afd Frances but for as much as the damages of the same William by Occasion of the premisses is not known the Justices here at the prayer of the afd William and by the Consent of the afd Francis by her attorney afd according to act of assembly in Such Case made and provided assessed the damages of the afd William by occasion of the non performance of the promise and assumption afd beyond his Costs and Charges by him about his Suit in that part apposed to three pounds five Shillings & Eight pence Curr.t money Therefore it is Considered that the aforesaid William Draper recover against the afd Frances Bowger his damages aforesaid to the afd three pounds five Shillings and Eight pence Curr.t money by the Justices afd in form aforesaid assessed as also pounds of tobacco for his Costs and Charges aforesaid to the Same William Draper at his request by the Court here adjudged and the afd defend.t in Mercy &a |
