229 Came the af.d Mary Tate by Francis Allen her attorney saves and the af.d sherriffe to witt Joseph Macclester Gent now here returned that he had taken the af.d Aaron Lynn whose body hereat this day he had ready to answer the af.d Mary Tate of the af.d plea as to him it was Commanded And hereupon the said Mary Tate declared against the aforesaid Aaron Lynn in form following somerset sst Aaron Lynn Late of Somerset County planter was attached to answer unto Mary Tate Called Mary Wallis the widdow and Admrx of all and singular the goods and Chattells and Creditts of John Wallis of the said County Marriner lately dec.d of a plea of trespass upon the Case &a And whereupon the said Mary by Francis Allen her attorney Complains that whereas the said Aaron the Twenty Second day of May Ann Dom seventeen hundred and thirty three at a certain place Called Philadelphia to witt at Somerset County af.d within the Jurisdiction of this Court had accounted together with the said John in his Lifetime for sundry sums of Money by the said Aaron to the said John before that time due owing and unpaid and upon that account the said Aaron was found in arrear to the said John in the sum of Twenty pounds six shillings and Nine pence Current money of Philadelphia (being of the value of Twenty pounds six shillings and Nine pence Current money of Maryland) as by a certain Note by the said Aaron signed and here unt^o^ annexed may in Court appear And so being so thereof Indebted the said Aaron in Consideration thereof the day and and year aforesaid at the place aforesaid upon him self did assume and to the said John in his Life time then and there did faithfully promise that he the said Aaron the said Twenty pounds six shillings and Nine pence to the said John in his life time when he should be thereunto requested well and faithfully he would pay and Content Neverthelesse the said Aaron his promise and assumption aforesaid in form afd made nothing regarding but plotting and fraudulently intending the said John in his Life time and the aforesaid Mary since the death of the said John in that part Craftilly and Subtilly to dcieve and defraud the said twenty pounds six Shillings and nine pence to the said John in his Life time or to the aforesaid Mary since the death of the said John to whom administration of all and Singular the goods and Chattells and Creditts of the said John at the time of his death by Nehemiah King Gent deputy Commissary in and for the County of Somerset afd Lawfully Constituted (to whom the Granting of ^the^ Adminiscon aforesaid of right did appertain/ the first day of March Ann Dom Seventeen hundred thirty four five at the County of Somerset aforesaid in due form of Law was Committed) hath not paid or in any sort Contented altho the Same to do the said Aaron after the promise and assumption afd made to witt on the aforesaid Twenty Second day of May in the Year first aforesaid and often afterwards at the County afd by the afd John in his Life time and by the afd Mary after the death of the said John and after the administration afd to the said Mary as afd Committed to witt ^on^ the first day |
