228 their attorneys aforesaid And whereupon the said John Baker as before defends the force and Injury when &a and saith that he did not assume upon himselfe upon in manner and form as the aforesd Duncan above against him hath Complained and of this he puts himselfe upon the Country &a And afterwards the afd John by his attorney afd relinquisheth his verifycation afd by him above pretended and saith that he Cannot deny the action afd of the afd Duncan nor Can he Say but that the said John did assume upon himselfe in manner and form as the afd Duncan above against him hath Complained and as to the damage of the Same Duncan by him by occasion of the premisses in that part Sustained the same John saith and acknowledgeth that the afd Duncan hath sustained damages by occasion of the premisses beyond his Costs and Charges by him about his suit in that part apposed to nine pounds Nineteen Shillings and ten pence Curr.t money of Maryland and not more and because the afd Duncan denys not this but the same allegation believes to be true prays Judgment for those damages above acknowledged together with his Costs and Charges afd to him to be adjudged &a Therefore by Consent of the parties afd it is Considered that the afd Duncan Murray recover against the aforesaid John Baker his damages aforesaid to the aforesaid Nine pounds ninteen Shillings and ten pence Curr.t money of Maryland by the same John in form afd acknowledged as also pounds 309 of tobacco for his Costs and Charges afd to the same Duncan at his request by the Court now hereof the assent of the parties afd adjudged which Certain damages in the whole amount to Nine pounds nineteen Shillings and teen pence Curr.t money and pounds of tob.o and the afd John in mercy &a
